1. Acceptance of Terms
By accessing or using Hoably ("hoably.co"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform. These terms apply to all users, including HOA board members, property managers, residents, and visitors.
2. Service Description
Hoably is a software-as-a-service (SaaS) platform for homeowners association management. The platform provides tools for community communication, payment processing, document management, maintenance tracking, amenity booking, and other HOA operations. Features may be added, modified, or removed at our discretion.
3. User Accounts
You must create an account to access most features of Hoably. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update it as necessary.
4. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of any applicable laws
- Upload or transmit harmful code, malware, or any content that could damage the platform
- Attempt to gain unauthorized access to other users' accounts or platform systems
- Harass, threaten, or intimidate other users through the platform
- Use the platform to send unsolicited communications or spam
- Interfere with or disrupt the platform's operation or security
5. Payments and Billing
Certain features of Hoably require payment. Payment processing is handled by Stripe. By making payments through the platform, you agree to Stripe's terms of service. HOA dues, assessments, and other fees are set by your HOA and processed through Hoably. We are not responsible for the amounts charged by your HOA.
6. Intellectual Property
The Hoably platform, including its design, features, code, and content, is owned by Hoably and protected by intellectual property laws. You retain ownership of content you upload to the platform but grant us a license to use, store, and display that content as necessary to provide the service.
7. Limitation of Liability
To the maximum extent permitted by law, Hoably and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.
8. Disclaimer of Warranties
The platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free service.
9. Termination
We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may terminate your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately.
10. Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by posting the updated terms on our website. Your continued use of the platform after changes are posted constitutes acceptance of the revised terms.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
